I'm Dan Smith your host, the supervising attorney for San Diego Defenders. The advice that we're giving you here is not legal advice; it's merely educational to help you navigate through the waters of a DUI. Today we're going to talk about the DMV. You got arrested last night. You have this pink sheet of paper that they gave you, it says temporary driver's permit admin per se across the top. What does that mean? What do I do? Well that means that you have ten days from that moment that you get that pink piece of paper to call the DMV and to set what's called a DMV hearing. Now driving is a privilege and not a right therefore you don't get a jury or anything like that; you have a hearing officer with the DMV. We have to talk to that hearing officer about three issues concerning whether or not you were driving with a .08 or greater, whether there was reasonable cause for the stop, and whether there was probable cause for the arrest. Those are three issues that have to be addressed. They mean the world to you; they mean your license, your job, the ability to get your kids to the doctor, all sorts of things, and we need to protect that right.
